Local Elections (Petitions and Disqualifications) Bill 1974

The proposal would create a single way to challenge a local election: an eligible person, or the Attorney General in cases involving electoral offences, could bring a case to the Circuit Court within set time limits. The court could recount votes, correct the result, remove an improperly elected member or, where necessary, order a new election; it could also penalise dishonest attempts to withdraw a challenge. It would remove several restrictions on membership of local authorities and certain education and agriculture committees, including restrictions affecting non-Irish citizens, ministers of religion and people holding paid positions. Ministers could also allow specified groups of local-authority employees to serve as elected members without losing their jobs, subject to rules made after consultation.
