Fifteenth Amendment of the Constitution (No. 2) Bill, 1995

The proposal would amend the Constitution to allow a court to grant a divorce. A couple would have to have lived apart for at least four years during the previous five, with no reasonable prospect of reconciliation. The court would also have to be satisfied that proper arrangements were in place for the spouses, their children and any other people covered by law, and that any further legal conditions had been met. It mattered because it would replace the constitutional ban on divorce with a limited, court-controlled process.
