The proposal would amend the Constitution to allow legislation refusing bail to someone charged with a serious offence when a court reasonably considers this necessary to prevent that person committing another serious offence. It would create an exception to the general right to bail, but only for serious charges and where preventing further offending justifies detention. The change would allow the Oireachtas to set the detailed rules, while leaving the decision in individual cases to the courts. The measure was passed by both Houses of the Oireachtas on 23 October 1996.
