Would allow the Labour Court, at a union’s request, to examine a workplace dispute where the employer does not normally negotiate collectively, internal procedures have failed and the recommended dispute-resolution process has been followed without industrial action. The Court could recommend changes to pay or working conditions and, if the dispute continued, issue a written determination that could be enforced through the courts, reviewed after three months and challenged in the High Court on a legal point.
