Criminal Justice (Temporary Release of Prisoners) Bill 2001

The measure would give the Justice Minister a clearer legal framework for temporarily releasing prisoners, including for rehabilitation, preparation for release, helping Gardaí, or health and humanitarian reasons. Decisions would have to consider public safety, the offence, behaviour, and the risk of reoffending or not returning; some serious offenders and people awaiting court appearances would be excluded.

Bill entitled an Act to provide for the temporary release of persons serving sentences of imprisonment, or of detention in St. Patrick's Institution, or persons being detained in a place provided under section 2 of the Prisons Act, 1970, and, for that purpose, to amend the Criminal Justice Act, 1960
