Road Traffic Bill 2003

The Road Traffic Bill 2003 would clarify and update the rules for preliminary roadside breath tests. Gardaí could require a driver to provide a breath sample not only when they suspect alcohol use, but also when the driver was involved in a collision or committed a traffic offence; refusing could lead to arrest, a fine of up to €2,500, or up to six months in prison. A person arrested for refusing the test could also be required to give a blood, urine or evidential breath sample.
