Transfer of Execution of Sentences Bill 2003

The proposal would let Ireland ask another country to enforce an Irish prison sentence when someone convicted here flees to their country of nationality, and would allow Ireland to enforce certain foreign sentences when Irish nationals flee back here. The Justice Minister’s consent and High Court approval would be required, with checks that the conviction is final, the offence is also a crime in Ireland, and normally at least six months remain; Ireland could reduce a foreign sentence that exceeds the Irish maximum. It also sets out arrest procedures, including temporary arrest while documents are being obtained.

Bill entitled an Act to give effect to Article 2 of the Additional Protocol to the Convention on the Transfer of Sentenced Persons done at Strasbourg on 18 December 1997 and Chapter 5 of Title III of the Convention implementing the Schengen Agreement of 14 June 1985 between the governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders done at Schengen on 19 June 1990
