Air Navigation and Transport (International Conventions) Bill 2004

Ireland would ratify the 1999 Montreal Convention and give it the force of law, replacing older international rules on airlines’ responsibility for death, injury, lost or damaged baggage and cargo, and delays. Passengers would benefit from higher compensation limits, especially when flying with non-EU airlines, and could generally sue in the country where they principally live. The legislation would bring the relevant rules together in one Act, preserve older rules for countries that have not adopted the Montreal Convention, and allow limited extensions or exceptions for domestic, military and non-commercial state flights.
