Planning and Development (Amendment) Bill 2004

Planning authorities could refuse a new planning application where the applicant, or a closely connected person or company, had substantially breached an earlier planning permission and there was a real risk of another breach. The authority would have to notify the applicant, who could ask the High Court to stop the proposed refusal; if the court allowed the application to proceed, the authority would have eight weeks to decide it. The applicant could also agree to extend the normal decision period by up to six months.
