Planning and Development (Amendment) Bill 2005

The proposal would tighten the rules for developers with a history of substantially failing to comply with planning permissions, including connected companies, partnerships and directors. Planning authorities could refuse a new application where they believe there is a real risk of another failure; the applicant would then have 21 days to ask the High Court to overturn the refusal, with no further appeal if the refusal is upheld. It would also make developers, managers and funders responsible for taking reasonable steps to complete estates properly, allowing people who suffer loss from a breach to seek damages.
