Competition (Trade Union Membership) Bill 2006

The proposal would allow trade unions to organise and negotiate collectively for people who personally provide work or services, even if they are treated as self-employed contractors rather than employees. It would protect such negotiations from competition-law rules on anti-competitive agreements when dealing with businesses, while still preventing price-fixing in services sold directly to consumers. The aim is to stop workers losing both employment protections and the ability to bargain collectively when employers classify them as self-employed.
