Land and Conveyancing Law Reform Bill 2006

The proposed legislation would modernise Ireland’s land and property law by replacing a large body of outdated rules and repealing many obsolete statutes dating back centuries. It would simplify land ownership, trusts, co-ownership, easements, property sales and deeds, while making it easier to register rights and prepare for electronic conveyancing. New rules would protect homeowners and buyers in mortgage enforcement, clarify when lenders can take possession or sell property, and allow courts to resolve disputes involving co-owned land, trusts, neighbours and restrictive agreements. It would also allow certain trusts to be changed for the benefit of people unable to consent, and provide that rent reviews in new business leases could go up or down rather than only upwards.
