Criminal Law (Admissibility of Evidence) Bill 2008

The Bill would end the automatic exclusion of evidence obtained by breaching an accused person’s rights. Courts would instead balance those rights against victims’ rights, the public interest and confidence in justice, while considering how serious and deliberate the breach was; courts could also refer Garda misconduct to the Garda Ombudsman.
