Civil Liability (Amendment) Bill 2008

The proposal would remove the €25,394.76 limit on compensation for the mental distress suffered by close family members after a person’s fatal injury. The limit currently applies to the total amount shared among eligible dependants, and does not include claims for lost financial support or funeral costs. Removing it would allow the judge to decide an appropriate amount in each case, taking the family’s circumstances into account. It would take effect one month after becoming law.
