The Mental Health Bill 2008 would retrospectively validate certain current and past orders extending a person’s detention for mental-health treatment, where the order failed to state an end date or the psychiatrist did not consider choosing a shorter period. For current cases, a psychiatrist would have five working days to examine the patient and issue a replacement order, while treatment and review arrangements would continue; patients’ existing rights and court proceedings would be protected.

Bill entitled an Act to confirm certain unexpired and expired renewal orders made under section 15(2) or (3) of the Mental Health Act 2001; to permit such unexpired renewal orders to be replaced by orders made under this Act; to provide that such new orders shall take effect as if they were renewal orders made under section 15(2) or (3) of the Mental Health Act 2001; and to provide for related matters
