The Residential Tenancies (Amendment) (No. 2) Bill 2009 would require landlords to send tenants’ deposits to the Private Residential Tenancies Board when registering a tenancy, rather than holding the money themselves. The Board would return the deposit as agreed by both parties, or decide how it should be divided if there is a dispute, including deductions for unpaid rent or damage; landlords who refuse without good reason could face damages. Deposits would be invested while held, with enough money kept available for repayments. The Bill would also generally prevent rent-related welfare payments for unregistered tenancies, while still allowing initial rent or deposit assistance when a tenancy is being created.

Bill entitled an Act to amend the Residential Tenancies Act 2004 so as to provide for the payment of deposits to the Private Residential Tenancies Board in respect of tenancies required to be registered under Part 7 of that Act; to require further that payments of supplementary welfare allowance under the Social Welfare Acts in respect of rental payments shall be paid only in respect of a tenancy registered with the Board; and to provide for connected matters
