Residential Tenancies (Amendment) Bill 2009

The measure would retrospectively confirm the appointments of certain members of the Residential Tenancies Board’s dispute resolution committee and the proper formation of tenancy tribunals, even if appointment rules had not been followed. It would also validate decisions and other actions taken by those bodies that might otherwise have been legally ineffective solely because of those procedural problems. Any validation would remain subject to protecting people’s constitutional rights.

Bill entitled an Act to deem the appointment, or purported appointment, of certain members of the dispute resolution committee to be valid; to deem to be validly constituted any tenancy tribunal constituted, or purporting to have been constituted, under section 102 of the Residential Tenancies Act 2004; and to provide for matters connected therewith
