Medical Practitioners (Professional Indemnity) (Amendment) Bill 2009

Doctors in Ireland would have to hold medical indemnity insurance—cover for claims arising from negligent treatment—if the Medical Council classifies them as requiring it. The Council would set minimum cover levels for different types of doctors, approve insurance providers and require proof of cover before issuing a certificate to practise. Insurers would have to report cancelled or lapsed cover, and doctors continuing to practise without it, or falsely claiming to be insured, could face disciplinary action, fines or imprisonment. The aim is to ensure that patients injured by negligent treatment have a better chance of receiving compensation, including where doctors from outside Ireland practise here.
