Twenty-ninth Amendment of the Constitution Bill 2009

The proposal would change the Constitution so judges’ pay could be reduced during a serious economic emergency, where cutting public-service pay was necessary to stabilise the State’s finances. Any reduction would have to be comparable to cuts affecting public servants generally or a similar group, helping protect judicial independence while avoiding the perception that judges were exempt from shared sacrifices. It could also remove doubts about applying measures such as the public-service pension levy to judges.
