Competition (Amendment) Bill 2011

The Competition (Amendment) Bill 2011 would strengthen enforcement against anti-competitive agreements, abuse of market power and other breaches by increasing fines, prison terms and continuing daily penalties. It would let the Competition Authority and ComReg bring separate court actions, make it easier for people harmed by illegal conduct to claim compensation, and prevent offenders from avoiding a recorded conviction; convicted businesses would generally have to pay investigation and prosecution costs. Courts could also disqualify responsible people from serving as company directors.
