Family Home Protection (Miscellaneous Provisions) Bill 2011

The proposal would give courts limited discretion when deciding whether a lender should repossess a family home because of mortgage arrears. Courts could consider factors such as the borrower’s repayment or restructuring offer, the arrears, the home’s current and likely future value, the lender’s conduct and any relevant conduct rules, along with other matters they consider fair.
