Medical Practitioners (Amendment) Bill 2012

The Bill would require specified medical practitioners to have professional indemnity cover—insurance or equivalent protection for claims arising from their medical practice, including alleged negligence. It would give the Medical Council power to set who must be covered, minimum cover levels and approved providers, check compliance, and take action where cover lapses or is falsely claimed; doctors covered entirely by the State’s Clinical Indemnity Scheme would count as complying. Employers would have to check cover before hiring doctors, and doctors would have to disclose relevant facts to providers and display proof of cover at their main practice.
