Privacy Bill 2012

The Privacy Bill 2012 would create a new civil claim for deliberately invading someone’s privacy without legal authority, including unauthorised surveillance, revealing information obtained through surveillance, using someone’s identity commercially, or disclosing personal information to harass them. Courts would balance privacy against matters such as public interest, law enforcement, public safety and responsible journalism; they could award damages, stop publication, order material returned, require an apology or grant other relief. Claims would generally have to be brought within two years, and cases could be heard privately without a jury.
