Landlord and Tenant (Business Leases Rent Review) Bill 2012

The Landlord and Tenant (Business Leases Rent Review) Bill 2012 would ban clauses in business leases that allow rent to rise but never fall. It would apply to the business-use part of existing and future leases, allowing rent reviews to result in a lower, higher or unchanged rent, regardless of contrary lease terms or side agreements. Its aim was to protect businesses, particularly retailers, from unsustainable rents during economic difficulty.

Bill entitled an Act to make provision for the prohibition of clauses within business leases which provide exclusively for the upward review of the rent payable under the lease and to ensure that all existing business leases may be reviewed in a manner that allows for the fixing of a rent which is less than, greater than or the same as the amount of the rent payable prior to the date on which the rent is reviewed
