Business Undertakings (Disclosure Of Overpayments) Bill 2012

Businesses that receive an accidental overpayment would have to tell the payer within 60 working days, provide relevant details on request and follow the payer’s instructions about returning or otherwise handling the money. People could complain to the Minister, who could appoint officers to investigate; concealing an overpayment or leaving it out of accounts would be offences, with penalties for businesses or individuals. The aim is to prevent businesses from unfairly keeping or misusing money paid by mistake.

Bill entitled an Act to require undertakings in receipt of overpayments to inform the payer of the occurrence of the overpayment and to facilitate the repayment of the overpayment; to permit the investigation of complaints concerning the non-disclosure or non-return of such overpayments; to create certain offences and to provide for related matters
