Rights of Grandparents Bill 2013

The Rights of Grandparents Bill 2013 would remove the requirement for grandparents to get a court’s permission before applying for access to a grandchild. It would broaden the definition of “grandparent” and require courts to consider the existing relationship, any possible harm or disruption to the child, the parents’ views and, most importantly, the child’s wishes when deciding access.

Bill entitled an Act to remove the obligation imposed on the grandparents of a child to first apply and obtain leave before exercising the right to apply for access to a grandchild, to regularise the day-to-day care of children in order to facilitate the development of a relationship or a bond between a grandparent and their grandchildren and persons in loco parentis where appropriate, to amend the Guardianship of Infants Act 1964 and to provide for related matters
