Land and Conveyancing Law Reform Bill 2013

The Bill would clarify that certain older legal rules still apply to mortgages created before 1 December 2009, removing uncertainty about lenders’ rights to seek repossession. It would also allow a court to pause repossession proceedings involving a person’s main home for up to two months, with a possible further pause, so the borrower and lender can consider a Personal Insolvency Arrangement. The aim is to restore the position intended when the 2009 law was passed while giving struggling homeowners an opportunity to explore an alternative to repossession.

Bill entitled an Act to provide that certain statutory provisions apply to mortgages of a particular class notwithstanding the repeal and amendment of those statutory provisions by the Land and Conveyancing Law Reform Act 2009, to provide for the adjournment of legal proceedings in certain cases and to provide for related matters
