The Bill would remove the law that broadly criminalised consensual sex involving people with mental impairments. It would instead criminalise exploiting a relationship of dependence or trust for sex, and define consent for everyone as agreeing to a specific act while understanding its physical nature, without applying higher standards to people with disabilities.

Bill entitled an Act to make it an offence for a person to abuse a position of dependence and trust for sexual purposes and to provide a statutory test for determining the existence of consent in respect of sexual acts and for that purpose to amend the Criminal Law (Sexual) Act 1993 and to provide for related matters
