Civil Debt (Procedures) Bill 2015

The Civil Debt (Procedures) Bill 2015 would allow the District Court to order deductions from a person’s wages or certain social welfare payments to repay an unpaid court judgment of between €500 and €4,000. Deductions would take account of the person’s financial circumstances, with opportunities to provide information, challenge or vary the order, and protections against reducing social welfare below a minimum level; it would also remove outdated references to imprisoning people for unpaid debts.

Bill entitled an Act to provide for the enforcement of court judgments in relation to certain debts; to provide for the making by the District Court of attachment of earnings orders and deduction from payments orders in certain circumstances; to amend the Debtors Act (Ireland) 1872 to remove references to the imprisonment of debtors for non-payment of debt; and to provide for related matters.
