The measure would change pension rules so that a worker’s spouse or civil partner is not denied a survivor’s pension simply because the relationship began after a scheme’s age limit, where the couple could not legally marry or enter a civil partnership earlier because they were the same sex or because civil partnership law was not yet in force. It would cover cases where the couple married or formed a recognised partnership within 36 months of it first becoming legally possible. The aim is to fix an unfair gap in occupational pension schemes that affected same-sex couples.

Bill entitled an Act to amend the provisions of the Pension Act 1990 relative to equal pension treatment in occupational benefit schemes in order to provide for cases where employees who were unable to marry persons of the same sex may be deprived of certain pension benefits, and to provide for related matters
