Health Disclosure Bill 2016

The Health Disclosure Bill 2016 would require health providers to have a clear process for telling patients, or their families if the patient cannot do so, about serious treatment-related incidents that cause death, serious injury or other harm. It also says they must explain what happened, what it means for the patient, what treatment or help is needed, and what steps are being taken to prevent the same thing happening again. An apology or offer of help would not by itself count as admitting legal fault, but hiding or destroying relevant records during an investigation could be a criminal offence.
Formal long title
Bill entitled an Act to provide for a procedure to facilitate the disclosure of a patient safety incident; and to provide for related matters.
