Criminal Justice (Suspended Sentences of Imprisonment) Bill 2016
Public bill · Government · Presented
The measure would change how suspended prison sentences are dealt with when someone commits a new offence while still under suspension. It would set a clearer process for sending the person back to the court that imposed the original suspended sentence, pause that process if the new conviction is appealed, and generally require the original suspended sentence to be served after the new sentence, unless the court thinks that would be unfair. It was brought in to clarify the law after a court ruling found part of the existing rules unconstitutional.
Formal long title
Bill entitled an Act to amend section 99 of the Criminal Justice Act 2006 in certain respects; and to provide for related matters.
