Data Protection Bill 2018

Sets up a new Data Protection Commission to replace the current commissioner and give Ireland a stronger, more independent watchdog for how personal data is collected, used, shared and protected. It brings Irish law into line with the EU’s tougher privacy rules, adds detailed rules for public bodies, children’s data, sensitive information, data breaches, cross-border transfers and law-enforcement processing, and gives the Commission powers to investigate, order changes and fine breaches. It matters because it strengthens people’s privacy rights while also giving organisations clearer rules on what they can and cannot do with personal data.

Bill entitled an Act to establish a body to be known as An Coimisiún um Chosaint Sonraí or, in the English language, the Data Protection Commission; to give further effect to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation); to give effect to Directive (EU) 2016/680 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, and on the free movement of such data, and repealing Council Framework Decision 2008/977/JHA; to give further effect to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data done at Strasbourg on the 28th day of January 1981 and for those and other purposes to amend the Data Protection Act 1988; to provide for the consequential amendment of certain other enactments; and to provide for related matters
