Child Care (Amendment) Bill 2018

The proposal would change child care law so that, when a child needs urgent protection, a child care service provider can lawfully keep the child in its care before an emergency care order is made. It also makes clear that the provider has a direct duty of care to the child while doing so, and that this arrangement would not count as a fostering relationship. It matters because it aims to remove legal uncertainty in emergency child protection situations.
