Personal Injuries Assessment Board (Amendment) Bill 2018

The Personal Injuries Assessment Board (Amendment) Bill 2018 would tighten how personal injury claims are handled when people do not provide information the Board asks for, or do not attend a medical examination without a good reason. In those cases, a court hearing the claim could take that failure into account, decide what extra evidence can be used, and possibly refuse to award court costs to the person who did not cooperate. It would apply the same approach if the respondent in a claim fails to supply requested information. The Bill would also require the Board to publish the “Book of Quantum” setting out general guidance on injury awards and to update it at least every three years.
