Regulation of Tenderers Bill 2019

Aimed at public construction contracts above the EU threshold, this proposal would let contracting authorities scrutinise unusually low bids and ask the bidder to explain how the price is workable. If the explanation is not good enough, the bidder could be ruled out, and decisions on such bids would have to be reported to the Office of Government Procurement. It would also allow firms to be excluded from public tenders if they have shown serious or repeated failings on earlier public contracts.

Formal long title

Bill entitled an Act to provide that abnormally low tender bids for construction works with a contract equal to or above the EU threshold for public works are regulated, and disqualified if their low level is not adequately explained to the relevant authority, and that performance in prior public contracts be grounds for exclusion from participation in a procurement procedure.
