Prohibition of Bogus Self Employment Bill 2019

The proposal would make it an offence for an employer to deliberately label a worker as self-employed when they are really an employee, helping to stop firms avoiding proper tax, pay, and workplace protections. It would allow the Workplace Relations Commission to investigate and prosecute these cases, punish offenders with a fine or up to 12 months in prison, and hold company directors or managers personally responsible if they were involved. It also gives a defence where the employer took reasonable care and checked the status properly.
