Civil Liability and Courts (Amendment) Bill 2019

Raises the penalty for fraudulent personal injury or civil claims and makes it harder for people who bring such cases unsuccessfully to avoid paying the other side’s legal costs. It would also increase the District Court’s maximum fine under the 2004 Act from €3,000 to €5,000, while still allowing a judge to step back from a costs order if making one would be unfair. That matters because it aims to discourage dishonest claims and strengthen the consequences for abuse of the courts.
