Criminal Justice (Judicial Discretion) (Amendment) Bill 2019

A judge would be allowed to set a fixed prison term in cases where the law currently uses a more open-ended sentence. In murder and treason cases, the court would also have to take account of any time the person had already spent in custody while waiting for trial or sentence. It matters because it would make sentencing clearer and ensure pre-trial detention is not overlooked.

Bill entitled an Act to amend section 2 of the Criminal Justice Act 1990 and to provide for related matters.
