Criminal Justice (Mutual Recognition of Decisions on Supervision Measures) Bill 2019

Public bill · Government · Presented

Allows Irish courts and courts in other EU countries to let a person accused of an offence live at home under bail conditions that are monitored in the country where they normally reside, instead of being held in custody while awaiting trial. It also sets out how Irish authorities and other Member States share information, check compliance, adapt conditions if needed, and act if the person breaches bail or cannot be found. It matters because it can reduce unnecessary detention, help accused people return to their home country, and keep supervision enforceable across EU borders.

Formal long title

Bill entitled an Act to give effect to Council Framework Decision 2009/829/JHA of 23 October 2009 on the application, between Member States of the European Union, of the principle of mutual recognition to decisions on supervision measures as an alternative to provisional detention; and to provide for related matters.
