Defective Dwellings Bill 2021

Creates a legal duty on builders, developers and subcontractors to make sure homes and other residential works meet the required standards and comply with building rules. It also gives homeowners, and owners’ management companies in apartment developments, a way to seek redress for defects, with claims generally starting when the problem is discovered and subject to time limits. It matters because it would strengthen protection for people who buy defective homes and make it harder for those responsible to avoid liability.

Formal long title

Bill entitled an Act to make provision for the law relating to the liability of builders, developers and others involved in the carrying out of residential construction works; to specify certain requirements applicable to residential construction works; to provide for certain duties to apply to such works; to provide for a means of redress for persons affected by housing defects and to specify the limitation periods relating to claims for such redress and to provide for related matters.
