Land and Conveyancing Law Reform Bill 2021

The measure would stop the 2009 land law changes on long-used rights of way and similar rights from kicking in after 30 November 2021, because those rules were creating uncertainty and delays for property sales and loans. It would restore the older, familiar approach for most future claims, keep existing cases already in train from being disturbed, and leave special longer time requirements for claims against State land and foreshore. It also makes it easier to register these rights, while removing a separate rule on extinguishing them that was added in 2009.

Bill entitled an Act to amend the law relating to the acquisition of easements and profits à prendre by prescription; to repeal certain provisions of the Land and Conveyancing Law Reform Act 2009, including section 39 of that Act relating to the extinguishment of easements and profits à prendre; to amend the Registration of Title Act 1964; and to provide for related matters.
