Civil Liability and Courts (Amendment) Bill 2021

A new offence-fraud-focused amendment would make it tougher to bring false insurance or injury claims by making unsuccessful claimants more likely to pay the other side’s legal costs, unless a judge thinks that would be unfair. It would also let a court send suspected fraudulent cases to the Director of Public Prosecutions, if the court chooses, and raise the District Court fine for offences under the 2004 law from €3,000 to €5,000. The aim is to deter bogus claims and reduce the cost of fraud for people, businesses and insurers.
