Garda Síochána (Compensation) Bill 2021

Replaces the old Garda compensation rules with a faster, clearer process for paying compensation when a current or former Garda is injured or killed in a malicious incident. Claims would be first checked by the Garda Commissioner, with a right to independent review if needed, and then normally assessed by the Personal Injuries Assessment Board before any court case. It also updates related laws, allows cases to be heard in the appropriate court rather than always the High Court, and aims to cut delays and costs for injured Gardaí and their families.

Bill entitled an Act to establish a system to replace the system provided for under the Garda Síochána (Compensation) Acts 1941 to 2003 in order to provide for the granting out of public moneys of compensation for personal injuries (including injuries causing death) that were inflicted on a current or former member of the Garda Síochána as a result of a malicious incident; for that and related purposes to apply with modifications and to amend the Personal Injuries Assessment Board Act 2003, and to amend other enactments; to repeal the Garda Síochána (Compensation) Act 1941 and the Garda Síochána (Compensation) (Amendment) Act 1945; and to provide for related matters.
