Residential Tenancies (Amendment) Bill 2021

Changes the rules for tenancy tribunal cases so a landlord’s statement about intending to sell a property is treated as ordinary evidence, not automatically strong evidence. It also makes clear that the landlord has to prove the notice ending the tenancy and the required declaration are valid. The point is to make tribunal decisions fairer and clearer in disputes over ending a tenancy.

Bill entitled an Act to amend the Residential Tenancies Act 2004 to modify evidential presumptions in a Tenancy Tribunal and to clarify where the burden of proof lies at such a tribunal.
