Rules would be put in place to spot and challenge very low bids for public construction work at or above the EU spending threshold. If a bid is more than 15% below the average of the other bids, the authority would have to ask for a full explanation; if the explanation is not convincing, the bid would be rejected and the bidder disqualified. It would also let authorities bar companies from competitions where they have repeatedly performed badly on past public contracts, to reduce the risk of poor delivery and protect public money.

Bill entitled an Act to provide that abnormally low tender bids for construction works with a contract equal to or above the EU threshold for public works are regulated, and disqualified, if their low level is not adequately explained to the relevant authority, and that performance in prior public contracts be grounds for exclusion from participation in a procurement procedure.
