Employment Equality (Amendment) (Non-Disclosure Agreements) Bill 2021

The proposal would limit the use of non-disclosure agreements after workplace sexual harassment or discrimination, so employers could not use them to keep victims quiet or hide wrongdoing. An NDA would only be allowed where the person who experienced the harassment or discrimination asks for it, and it would have to meet clear conditions, be written plainly, and follow official rules. Any agreement made outside those rules would be invalid, and an employer who used one improperly could face an offence.
