Mental Health (Capacity to Consent to Treatment) Bill 2021

Aimed at young people aged 16 and over, this proposal would let them give valid consent to their own mental health treatment if they can understand the information, weigh up the options, and communicate a decision. It would recognise capable teenagers as having control over choices about their mental health care, instead of relying entirely on others to decide for them.

Bill entitled an Act to amend the Mental Health Act 2001 and for that purpose to provide for the right of minors over the age of 16 to consent to mental health treatment and to provide for related matters.
