Communications (Retention of Data) (Amendment) Bill 2022

The main change is to update the rules on keeping and sharing communications data so they fit European court rulings. It would keep some basic user data for 12 months, create a process for more sensitive traffic and location data to be retained only with a judge’s approval and a security assessment, and allow police, the Defence Forces and some regulators to seek access through new preservation, production and urgent-access orders. It also creates offences for failing to comply and lets the rules be updated as technology changes.

Bill entitled an Act to amend the Communications (Retention of Data) Act 2011; to provide for the retention in specified circumstances by providers of electronic communications services of certain data; to provide for the disclosure in specified circumstances of such data and to provide for related matters.
