Criminal Justice (Search Warrant Oversight) Bill 2023

The measure would stop Garda superintendents and other senior officers from authorising search warrants on their own, and require court approval instead. It is meant to add an independent check before searches of homes or premises can happen, so people’s rights are better protected while still allowing searches where they are justified.

Bill entitled an Act to amend the various acts to remove the ability for members of An Garda Síochána to issue authority to search premises without sworn information being required.
